The information below provides clarification regarding the content of our newsletter as well as the registration and mailing process, the statistical analysis process and your rights of objection. By subscribing to our newsletter, you are agreeing to receiving it and also to the procedure described.
Content of a newsletter
We only send out newsletters, emails and other electronic notifications with promotional information (hereinafter referred to as “ newsletter”) with the consent of the recipient or with legal permission. If the contents of a newsletter are specifically described within the scope of a registration, they are relevant to the consent of the users. Processing occurs in accordance with GDPR Art. 6 (1) lit. a, b and f.
Double opt-in and logging
A double opt-in procedure is used for subscription to our newsletter. This means that after registration you receive an email in which you are asked to confirm your registration. This confirmation is needed in order that no one can log in using a third party email address.
Subscriptions to the newsletter are logged in order that the registration process can be verified in accordance with legal requirements. This includes the storage of the time of login and confirmation, as well as the IP address. Changes to your data stored with MailChimp provider are also logged.
Use of the mailing service provider “MailChimp”.
The newsletter is sent out using “MailChimp”, a newsletter distribution platform from the US provider Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA.
The email addresses of our newsletter recipients as well as their other data described within this information, are stored on the MailChimp servers in the USA. MailChimp uses this information for the mailing and analysis of the newsletter on our behalf. Furthermore, MailChimp may utilise this data, according to the company’s own information, to optimise or improve its own services, e.g. for technical optimisation of the mailing and presentation of the newsletter or for commercial purposes in order to determine those countries from which the recipients originate. However, MailChimp does not use the data of our newsletter recipients in order to write to these itself or to forward this data to third parties.
We trust in the reliability as well as the IT and data security of MailChimp. MailChimp is certified under the US-EU Data Protection Agreement “Privacy Shield” and is therefore required to adhere to EU data protection regulations. We have also concluded a “Data Processing Agreement” with MailChimp. This is an agreement in which MailChimp undertakes to protect the data of our users, to process it on our behalf in accordance with its data protection provisions and, in particular, not to forward it to third parties. MailChimp’s data protection provisions can be viewed here.
Entering your email address is sufficient for subscribing to the newsletter.
Statistical collection and analysis
The newsletters contain a “web-beacon”, this is a pixel-sized file which is accessed by the MailChimp server when the newsletter is opened. When accessed, technical information such as information on the browser and your system as well as your IP address and the time of accessing the file is initially recorded. This information is used for technical improvements to services based on the technical data or on the target group and their reading behaviour using their access locations (which can be determined with the aid of the IP address) or access times.
The statistical recording also includes determining whether the newsletter has been opened, when it was opened and which links were clicked. For technical reasons, this information can in fact be attributed to the individual newsletter recipients. However, it is not our intention or that of MailChimp to monitor individual users. Instead, this analysis helps us to identify the reading habits of our users and to adapt content for them or to send out different content according to the interests of our users.
Online access and data management
There are cases in which we direct newsletter recipients to MailChimp websites. For example, our newsletter contains a link which the newsletter recipient is able to use to access the newsletter online (e.g. in the case of presentation problems in the email program). Newsletter recipients are also able to retrospectively correct their data, such as the email address. MailChimp’s data privacy statement can also only be accessed on their webpage.
In this regard, we would like to point out that cookies are used on MailChimp websites which means that personal data is processed by MailChimp, their partners and service providers used (e.g. Google Analytics). We have no influence on the collection of this data. Please refer to the MailChimp data privacy statement for further information.
You can cancel the receipt of our newsletter at any time, i.e. revoke your consent. Your consent to distribution of the newsletter via MailChimp and to the statistical analysis will also cease to apply at the same time. Separate revocation of the distribution via MailChimp or the statistical analysis is unfortunately not possible.
There is a link for termination of the newsletter at the end of each newsletter.
Legal basis – General Data Protection Regulation
In accordance with the requirements of the general data protection regulation which has been in force since 25 May 2018, we hereby inform you that consent to the mailing of email addresses is provided on the basis of GDPR Art. 6 (1a). The use of the mailing service provider MailChimp, implementation of statistical data collection and analysis and logging of the registration procedure occurs on the basis of our legitimate interest in accordance with GDPR Art. 6 (1a). Our interest is focused on the use of a user-friendly and secure newsletter system which serves both our commercial interests and also meets the expectations of the users.
We also point out that users can object at any time to the future processing of their personal data in line with the legal regulations as per GDPR Art. 21. Objection can be made in particular against processing for the purposes of direct advertising.
